1. Agreement to Terms


By subscribing to Atlas Tactics services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not subscribe to our services.

2. Description of Service


Atlas Tactics is a software-as-a-service (SaaS) platform provider that offers customer communication and business management software designed for home service professionals. Our services include:

• Professional website design and hosting

• Customer communication tools (text, email, social media)

• AI voice agent (Elite plan only)

• CRM and business management features

• Workflow automations

• Ongoing support and training

3. Subscription and Billing


3.1 Setup Fees

All plans require a one-time setup fee charged at the time of subscription. This fee covers the cost of

building your branded website, configuring your communication tools, training your AI voice agent (Elite plan), and setting up all automations.

3.2 Monthly Subscription Fees

3.3 Payment Methods

We accept major credit cards and debit cards through our secure third-party payment processor. By providing payment information, you authorize us to charge your payment method for all applicable fees.

3.4 Failed Payments

If a payment fails, we will attempt to charge your payment method up to three times. If payment cannot be processed after three attempts, your account may be suspended until payment is received.

4. Account Setup and Service Delivery


4.1 Information Required

You agree to provide accurate, complete, and current information during the signup process. You will complete a questionnaire providing business information, branding details, and service descriptions needed to build your system.

4.2 Setup Timeline

We will complete your setup within 7-10 business days from the date we receive all required information from you. Delays in providing information may extend this timeline.

4.3 Training and Handover

Upon completion of setup, we will provide video tutorials, documentation, and a live training session. After training, you will have full access to manage your own system.

5. Acceptable Use Policy


You agree to use our platform in compliance with all applicable laws and regulations. You may not use our services to:

• Send unsolicited bulk messages (spam)

• Harass, threaten, or abuse others

• Engage in fraudulent or illegal activities

• Violate intellectual property rights

• Distribute malware or harmful code

• Attempt unauthorized access to our systems

6. AI Voice Agent Specific Terms (Elite Plan Only)


6.1 Inbound Use Only

The AI voice agent feature is designed exclusively for answering inbound calls to your business. It may not be used for outbound calling, telemarketing, or any form of unsolicited communication.

6.2 Compliance with Telecommunications Laws

You are responsible for ensuring your use of the AI voice agent complies with all applicable laws, including the Telephone Consumer Protection Act (TCPA), Do Not Call regulations, and call recording consent laws in your jurisdiction.

6.3 Usage Limits & Overage Billing

Your Elite plan subscription includes up to 500 minutes of AI calling per month. Usage beyond this limit will be billed at $0.15 per minute. You authorize us to charge your payment method on file for any overage charges.

6.5 AI Limitations & Disclaimers

While our AI voice agent is designed to be accurate and reliable, we do not guarantee 100% accuracy in understanding all callers, perfect transcription, or zero errors in booking appointments. You are responsible for reviewing AI-generated bookings and information for accuracy before acting on them.

7. Data Ownership and Export


You own all customer data entered into or generated by our platform. You may export your data at any time through your account dashboard. Upon cancellation, your data will be retained for 30 days, then permanently deleted.

8. Service Availability


We strive for 99% uptime but do not guarantee uninterrupted service. The platform may occasionally be unavailable due to maintenance, technical issues, or third-party service disruptions. We are not liable for missed calls, lost business, or damages resulting from service interruptions.

9. Modifications to Service


We reserve the right to modify, suspend, or discontinue any part of our service at any time. We will provide 30 days' notice before making material changes that negatively impact your use of the service.

10. Termination


10.1 Termination by You

You may cancel your subscription at any time. See our Cancellation Policy for details.

10.2 Termination by Us

We reserve the right to terminate your subscription immediately if you violate these Terms, fail to pay subscription fees, or engage in abusive behavior toward our staff. No refunds will be issued for terminations due to violations.

11. Limitation of Liability


To the maximum extent permitted by law, Atlas Tactics LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, or business interruption, arising from your use of our services.

Our total liability for any claim arising from your use of our services shall not exceed the total amount you paid us in the 12 months preceding the claim.

12. Governing Law


These Terms are governed by the laws of Wyoming, USA , without regard to conflict of law provisions.

13. Changes to Terms


We may update these Terms from time to time. We will notify you of material changes by email or through your account dashboard. Continued use of our services after changes constitutes acceptance of the new Terms.


AI Voice Agent Usage Policy (Elite Plan Only)

What the AI Voice Agent Does


The AI voice agent is designed to:

• Answer inbound calls to your business phone number

• Qualify leads by asking pre-configured questions

• Answer common customer questions (FAQs)

• Book appointments directly into your calendar

• Send you notifications when calls are received

The AI voice agent is for inbound customer service only. It is not designed for, and may not be used for, outbound telemarketing, cold calling, or unsolicited communications.

Usage Limits


Elite Plan Includes: Up to 500 minutes of AI calling per month.

What Counts as Usage:

Only answered calls count toward your minutes

Unanswered calls, busy signals, and voicemails do not count

Usage is measured in 1-minute increments (rounded up)

Overage Charges


If you exceed 500 minutes in a billing month, additional usage will be billed at:

$0.15 per minute for minutes 501+

Example: If you use 600 minutes in a month:

• First 500 minutes: Included in your $497/month subscription

• Additional 100 minutes: 100 × $0.15 = $15.00 overage charge

Overage charges are billed automatically on your next billing date.

Acceptable Use


You MAY use the AI voice agent for:

✅ Answering inbound calls to your business

✅ Qualifying leads and potential customers

✅ Booking appointments for your services

✅ Answering frequently asked questions

✅ Providing business hours, pricing, and service information

You MAY NOT use the AI voice agent for:

❌ Outbound cold calling or telemarketing

❌ Unsolicited calls to consumers

❌ Calls to numbers on Do Not Call lists

❌ Robocalling or auto-dialing campaigns

❌ Calls that violate the Telephone Consumer Protection Act (TCPA)

Any illegal, fraudulent, or deceptive calling practices

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund.

You may not use our platform to:

Engage in fraudulent, deceptive, or misleading practices

Violate intellectual property rights

Distribute malware, viruses, or harmful code

1.2 Harmful Communications

Send unsolicited bulk messages (spam)

Harass, threaten, or abuse others

Impersonate any person or entity

Distribute illegal or obscene content

1.3 Unethical Marketing Practices

Send communications to individuals who have not opted in

Contact numbers on Do Not Call registries

Violate CAN-SPAM Act, TCPA, or similar regulations

Use purchased or scraped contact lists without proper consent

2. Enforcement


Violation of this Acceptable Use Policy may result in:

Warning

Temporary suspension of services

Permanent termination of your account

Reporting to law enforcement if applicable

Legal action to recover damages

No refunds will be issued if your account is terminated for violating this policy.
